The application was reported to the Planning and Licensing committee in accordance with the requirements of the Council’s constitution.

 

At the start of the presentation the case officer aurally corrected an error in the development description given at the top of the report to make it clear that the revised proposal was for a 15 metre tall mast reduced from the original 20 metre tall proposal.

 

The application relates to a permitted development proposal for a 15.0m monopole mast with integrated cabinet at base (1.8m long, 0.75m wide x 1.6m tall), three other equipment cabinets (1no 1.9m long x 0.7m wide x 1.75m high; 1 no 0.7m x 0.7m x 1.2m high; 1 no 0.5m x 0.6 m x 1.6m high) and associated ancillary works by a telecommunications code system operator (in this case CK Hutchison Networks (UK) Ltd known as Three’).

 

The site is part of the grass verge, a tongue of land between Ongar Road and Hulletts Lane, to the east of the double roundabout junction of Ongar Road, Orchard Lane and Coxtie Green Road.

 

The application makes particular reference to being part of the roll out of the 5G network but in discussions with the agent it is understood that the facility would also be part of the 3G and 4G network.

 

Mr Ovenden was present at the meeting and summarised the report.  He pointed out that this was not a planning application, but a prior notification to determine if prior approval is required of the siting and appearance of the proposal.

 

Mr Palmer from Orchard Lane Residents Association addressed the Committee objecting to the proposed application.

 

The Chair read a statement from Cllr Aspinell, acting as Ward Councillor, who was not present at the meeting, opposing the application.

 

Cllr Mrs Davies, addressed the Committee as Ward Councillor, objecting to the application, and advised she would not vote as she had made her views known prior to the meeting.

 

A motion was MOVED by Cllr Mynott to REFUSE the application and SECONDED by Cllr Barber.

 

Following a full discussion, a vote was taken and Members voted as follows:

 

FOR:  Cllrs Barber, Dr Barrett, Bridge, Cloke, Cuthbert, Fryd, Gelderbloem, Heard, Mynott, Tanner, Jakobsson (11)

 

AGAINST: (0)

At the start of the presentation the officer clarified that this is not a planning application but requires only that prior approval for siting and appearance be determined.

 

The application related to a permitted development proposal for an 18.0m monopole mast with integrated cabinet at base (1.8m long x 0.750m wide x 1.6m high), three other equipment cabinets (1no. 1.9m long x 0.6m wide x 1.752m high; 1no. 0.650m long x0.700m wide x 0.950m high; 1no 0.600 long x 0.520m wide x 1.585m high) and associated ancillary works by telecommunications code system operator (CK Hutchison Networks (UK) Ltd known as ‘Three’).

 

The site is a triangular shaped parcel of land located at the junction of Rayleigh Road and Tomlyns Close.  The land is laid to grass with a number of deciduous mature trees, otherwise the surrounding area is residential in nature. 

 

Cllr Hossack, Ward Councillor, addressed the Committee objecting to the application.

 

A motion was MOVED by Cllr Barber and SECONDED by Cllr Mynott to REFUSE the application

 

Following a full discussion, a vote was taken and Members voted as follows:

 

FOR:  Cllrs Barber, Dr Barrett, Bridge, Cloke, Cuthbert, Mrs Davies, Fryd, Gelderbloem, Heard, Mynott, Tanner, Jakobsson (12)

Ms Pride summarised the report advising that this was not a planning application but a prior approval to determine whether the siting and appearance is required and whether acceptable.

 

The application relates to a permitted development proposal for an 15 metre high monopole mast with an integrated cabinet at the base, 3 additional cabinets and ancillary works by a telecommunications code system operator (in this case CK Hutchison Networks (UK) Ltd known as ‘Three’).

 

The site is located on the west side of Nine Ashes Road on the junction with Meadow Rise and comprises a strip of grass verge highway land.  A mature hedge and trees form a soft landscape boundary separating the site from the closest residential dwelling, ‘Ashridge’, located immediately to south east. 

 

Cllr Keeble was present at the meeting and addressed the Committee on behalf of Blackmore, Hook End and Wyatt’s Green Parish Council objecting to the application.

 

Cllr Jakobsson spoke as Ward Councillor objecting to the application and withdrew his right to vote as substitute on the Committee.

 

A motion was MOVED by Cllr Bridge to REFUSE the application and SECONDED by Cllr Cuthbert.

 

Following a full discussion, a vote was taken and Members voted as follows:

 

FOR:  Cllrs Barber, Dr Barrett, Bridge, Cloke, Cuthbert, Mrs Davies, Fryd, Gelderbloem, Heard, Mynott, Tanner, (11)
