An objection had been received from Environmental Health manager, David Carter, with regards to two Temporary Event Notices (TENs) submitted in relation to Fight Camp boxing events to be held at Matchroom Sport, Mascalls, Mascalls Lane, Great Warley, Essex CM14 5LJ on Saturday, 31 July 2021 and Saturday, 7 August 2021. The objection related to the Prevention of Public Nuisance licensing objective.

 

 

Mr Dave Leonard, Licensing Officer introduced the report.  Representations were then heard from Mr David Carter, Environmental Health Manager and from the Applicant Mr John Hill and Mr Julian Bentley.

 

There were no other representations from any other responsible authorities.

 

The Committee had given careful consideration to both applications for a temporary event notice and has taken into account all of the written and verbal evidence presented, including the objection notice from Environmental Health. 

 

The committee heard evidence from the Environmental Health team regarding their concerns over the potential public nuisance which could be caused by a large number of spectators due to attend the proposed boxing events.

 

The committee heard from the applicant, who has undertaken to comply with a number of proposed conditions to address the concerns raised by Environmental Health. The committee is, however, mindful that these conditions cannot formally be attached to the temporary event notices, as there is no premises licence currently in place.

 

The committee also noted that the Environmental Health team stated that they now had confidence that the applicant would comply with these conditions and that they were content with the further discussions that they had with the applicant, since they submitted their objection notice.

 

The committee was somewhat concerned that the applicant believed that conditions could be attached to this application for a temporary event notice and formed the view that an application for a premises licence would have been more appropriate in the circumstances.

 

After taking into the account the representations made by the Environmental Health team and the applicant, the committee had sufficient assurances that the proposed events would not undermine the licensing objectives and therefore grants both applications. The committee would request that the applicant submits their agreement to the additional proposed conditions in writing to the licensing team.
