Determination of a current Combined Hackney Carriage and Private Hire Drivers Licence (Exempt)

Exempt report not to be published by virtue of Part 1 of Schedule 12 Local Government Act 1972 because it contains information relating to an individual.

Minutes:

An application had been made to renew a Combined Hackney Carriage and Private Hire Driver’s licence and the driver had been given a temporary licence.   The application needed to be considered by the Licencing Sub-committee due to a number of complaints having been received in reference to the driver’s conduct. 

 

The Sub-committee considered the evidence provided and heard from the applicant. Their decision was that the temporary licence would be revoked and that the application for a fresh licence would be refused as the driver was not considered to be a fit and proper person to be granted such a license under section 59 of the Local Government (Miscellaneous Provisions) Act 1976.

Minutes:

A complaint had been received from a local resident in relation to alleged dangerous driving and verbally abusive behaviour by a Brentwood Council licensed Hackney Carriage private hire driver. The decision to be made by the Licensing Sub-committee was whether the Licence-holder was a fit and proper person to continue to hold his license.

 

Following consideration of the evidence provided and the driver’s previous good character, Members decided not to revoke the licence.

Minutes:

Members were asked to consider whether the driver was a fit and proper person to continue to hold a Combined Hackney Carriage and Private Hire Drivers Licence following Licensing Officers observing five people exiting his vehicle which was only licensed to carry four passengers.

 

Members considered the evidence presented and heard from the applicant.  Their decision was that the driver’s licence should not be suspended or revoked but that the driver should take and pass an approved Taxi Driver Assessment within three months.
